West Virginia and the Streamlined Sales Tax program

West Virginia is a full member of the Streamlined Sales Tax program and has been since October 1, 2005, so if you register through the Streamlined Sales Tax Registration System (SSTRS) you file there under the program’s uniform rules. Municipal tax here is reported on schedules of the state’s combined return, so what you carry into the return is the municipality behind each sale, and there’s no second filing to make.

Is West Virginia in the Streamlined Sales Tax program?

Yes, as a full member, effective October 1, 2005. West Virginia is one of all 24 member states in the Streamlined Sales Tax program.

What SST membership changes for a seller collecting tax in West Virginia

West Virginia comes with the other member states when you register once, on how to register through the SSTRS. It uses the program’s shared definitions and sourcing rules, so one system files there. Selecting it starts an obligation, on what your ongoing obligations are after registering, and whether you qualify to have that work paid for is a separate test, on whether you qualify for free CSP services.

What is specific to West Virginia

Two things.

Municipal tax is reported on schedules of the combined state return. Vendors report the municipal tax they collect on the municipal schedules of the West Virginia combined sales and use tax return, so there’s no separate municipal filing to make and no municipal office to make it to. What that asks of you is the municipality behind each sale, carried through to the return instead of reconstructed when the return is due. Keep it attached in whatever prices your orders and the filing is data entry.

Motor vehicles and motor fuel sit outside the municipal tax. Neither is subject to municipal sales and use tax in West Virginia, so on those lines the municipal layer comes off. What decides that is the product, not the address it ships to, which makes it a category rule in your setup rather than a rate lookup. Code those two the way West Virginia treats them and you’re not correcting a fuel or vehicle line by hand later.

None of that goes away because West Virginia is a member state. Membership reached the state tax and the definitions behind it and left the municipal side exactly where it was: the schedules still ride on the return, the motor vehicle and motor fuel carve-out still stands, and the tax division still sets your filing calendar. None of it reaches the states outside the program at all.

Where to register and where to find current rates

Register through the SSTRS and select West Virginia. West Virginia sales and use tax carries the current state and municipal rates, the forms, and the filing dates, which municipalities impose a tax and what it doesn’t reach is on its municipal sales and use tax page, and the department’s own account of its participation is on its Streamlined Sales and Use Tax page.

We don’t publish a West Virginia rate or a filing date here on purpose: a number that changes belongs with the department that changes it.
